Roy Hardaker, a self-employed builder, has been given a suspended jail sentence due to one of his employees falling from a flat roof of a building. In 2013, Jason Fogarty, a casual employee of Hardaker, was working on a flat roof replacement project. The roof replacement was complete and the two men were installing cladding and flashing around the top of the building. Fogarty, for a reason unknown, climbed up onto the roof and subsequently fell from the edge. Sadly, he was pronounced dead at the scene.
After a joint investigation carried out by Greater Manchester Police and the HSE, they determined that the work was not properly and safely planned. There were no safety measures in situ, such as scaffolding edge protection to prevent falls from the edge of the roof.
